Il D.lgs. n. Legislative Decree No. 14 of 12 January 2019, the ‘Business Crisis and Insolvency Code’ (so-called Crisis Code), introduced significant and important changes regarding management methods and the procedures for companies in difficulty.
In order to be able to focus on business continuity, the legislation expressly requires entrepreneurs (Article 375(2) amending Article 2086 of the Italian civil code) to put in place an adequate (1) organisational, (2) administrative and (3) accounting structure aimed at the timely detection of the company's crisis and loss of business continuity.
